AIR GUN BY-LAW
1. This By-Law may be cited as the Town of Buchans Air gun By-Law.
2. For the purpose of this By-Law:
a. Air gun includes those guns commonly referred to as BB, Pellet Gun, Air Soft Gun and Paint Ball Gun.
3. Except as hereinafter provided it shall be unlawful for any person to fire or discharge an air gun in the Town of Buchans.
4. No air gun shall be transported or moved from the air gun holder’s private property except under the following conditions:
a. The air gun shall be rendered inoperable.
b. The air gun shall be, at all times, fully encased and enclosed in a case or holder made and used specifically for transporting the air gun and no part of the air gun shall be exposed to the public; and
c. All ammunition and compressed gas cylinders that may be used for the operation of the air gun shall, at all times, be entirely separate from the case in which the air gun is fully encased or enclosed.
5. A police officer may seize any air gun where there are reasonable and probable grounds to believe that an offense has been committed pursuant to Section 3 or Section 4.
6. Subsequent to the seizure of an air gun the owner may file an appeal requesting the air gun be returned for reasons as outlined in their appeal. Such appeals will be heard by the Town Council and if denied, or if an appeal is not filed within 30 days of seizure, the air gun will be destroyed.
7. The provisions of this By-Law shall not apply to:
a. Any person where prior approval for the discharge or use of an airgun has been received from the Town; and
b. The firing or discharge of an air gun on a range approved by the Town for the said use.
8. These Regulations shall come into effect on the 18 day of January , 2010, and may be cited as the Town of Buchans Air gun Regulations.
